We would like to inform you that Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ L 2016.119.1), hereinafter referred to as the “GDPR” or the “Regulation,” applies since 25 May 2018.

Terlecki & Partners Law Firm (Terlecki i Wspólnicy Kancelaria Prawna sp.j.) shall process your personal data in accordance with applicable legal regulations, in particular the GDPR and provisions of the Act on the protection of personal data. Personal data are any information allowing identifying a natural person and a person carrying out business activities. Due to the fact that the law office handles, inter alia, cases pertaining to genealogical and civic matters, some personal data may also refer to the ancestors of the Clients and their personal data, including the religion of these people.

Terlecki & Partners Law Firm (Terlecki I Wspólnicy Kancelaria Prawna sp.j.), with its registered office in Warsaw, collects personal data through the contact form published on the website at https://www.terlecki.net/, e-mail messages and ongoing business contacts.

The Privacy Policy presented below sets out the principles for the protection and processing of your personal data. At the same time, any time the following terms and notions are used herein, they shall have the meaning as defined below:

  1. User – a person visiting and using the website at https://www.terlecki.net/, and a person who granted their consent to the processing of their data and is interested in the Controller’s offer, taking up activities preceding conclusion of an agreement, as well as conclusion of an agreement with the Controller.
  2. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, p. 1).
  3. Personal Data – shall mean personal data within the meaning of Article 4(1) of the GDPR.
  4. Processing – shall mean the processing of Personal Data within the meaning of Article 4(2) of the GDPR.

  2. What data do we process?
    The Controller shall process personal data as necessary for the purposes specified in this Privacy Policy, that were transferred within the framework of activities carried out by the Controller.

    We process only data necessary from the point of view of provided services, i.e.:
    1. data allowing confirming the identify, such as first name and surname, data of birth, Personal Identification Number (PESEL), number of the ID card/passport;
    2. contact details such as telephone number, residential address, email address;
    3. tax identification data;
      and other data if required by the purpose specified in this Privacy Policy, including, in particular, data regarding marital status as well as data of the ancestors of the Client and their religion.
       
  3. What is the purpose of and legal ground for the processing of your data?
    The purpose of the processing of Personal Data by the Controller is conclusion and performance of the agreement for the provision of services and ongoing communication in relation to the provision of services.

    The processing of Personal Data is based on:
    1. point (a) of Article 6(1) of the GDPR, i.e. consent to the processing of data given by the data subject;
    2. point (b) of Article 6(1) of the GDPR, i.e. the processing is necessary for the performance of an agreement to which the data subject is party or in order to take steps at the request of the data subject prior to entering into an agreement;
    3. point (c) of Article 6(1) of the GDPR – processing is necessary for compliance with a legal obligation to which the Law Office is subject, imposed by regulations governing the provision of legal services, as well as accounting and tax regulations.
       
  4. Is the provision of personal data obligatory?
    Personal Data shall be provided voluntarily, but the provision of Personal Data is necessary for the conclusion of an agreement, for the steps aimed at entering into an agreement and for the performance of an agreement.

    Failure to provide Personal Data may make it impossible to respond to an inquiry sent to the Controller via the contact form published on the website at https://www.terlecki.net/, and to take steps aimed at entering into an agreement and the performance of an agreement.

    Terlecki & Partners Law Firm (Terlecki I Wspólnicy Kancelaria Prawna sp.j.) respects the privacy right of the Users, and therefore it takes care of the security of all data and information provided through the contact form published on the website at www.terlecki.net, as well as cookies, and information provided directly by e-mail or telephone.
     
  5. Are your data transferred to other entities?
    Personal Data shall be processed only by employees of Terlecki & Partners Law Firm (Terlecki I Wspólnicy Kancelaria Prawna sp.j.) and entities carrying out necessary activities on behalf of Terlecki & Partners Law Firm (Terlecki I Wspólnicy Kancelaria Prawna sp.j.) in relation to the provision of the service required/performance of an agreement, including, in particular, by entities providing accounting, financial, tax, IT, postal and courier services, as well as a certified translator, whereas data are transferred to these entities in a manner that ensures appropriate security of data.

    Personal Data will also be processed when required by legal regulations for the purposes of central government and local government administration authorities in Poland and the EU.

    Taking into account the fact that communication between the Controller and a data subject may take place in electronic form, including via e-mail systems, social portals, any mobile and computer applications, including applications for voice or video communication via the Internet, and the Controller does not have knowledge about the location of servers of entities providing these services, as a result the Controller would like to inform you that in relation to the above, it is possible that personal data will be transferred to a third country, i.e. when the servers of these service providers is located outside the territory of the EU. The Controller would also like to inform you that such transfer in the aforementioned instances is necessary for the correct performance of an agreement. Taking into account the above, when concluding an agreement with the Controller or giving consent to the processing of data based on point (1) of Article 6(1) of the GDPR, it is assumed that the data subject has made public their data regarding electronic communication with the Controller.
     
  6. How long will we process your data?
    Personal Data will be processed for the whole term of the agreement, and until limitation of possible claims under the agreement, as well as until limitation of public and legal liabilities in relation to the agreement concluded.

    In case of granting consent to the processing of Personal Data, Personal Data will be processed until the consent is withdrawn.
     
  7. What are your rights with respect to your data?
    You have the following rights related to the processing of Personal Data:
    1. right to obtain information about Personal Data processed by Terlecki & Partners Law Firm (Terlecki I Wspólnicy Kancelaria Prawna sp.j.);
    2. right to rectification of inaccurate data;
    3. right to erasure or restriction of processing of data, inter alia, when the data are no longer necessary in relation to the purposes for which they were provided;
    4. right to withdraw consent to the processing of personal data at any time.

      The Controller makes every possible effort to protect processed data, in particular against loss, unauthorised use or unauthorised access.

      If the User does not accept the provisions of this Privacy Policy, the User should stop using the Controller’s website, and in particular should not send inquiries via the contact form published on the website or send Personal Data to the e-mail address.

      We would like to inform you that the supervisory authority for personal data in Poland is the President of the Office for the Protection of Personal Data.
